Terms of Service

ACTIV is a technology platform that connects users with independent venue partners offering sports, fitness, and wellness activities.

ACTIV:

• Does not own or operate venues
• Does not provide physical services
• Acts only as an intermediary for booking and discovery

• Users must be 18 years or older to create an account
• Minors may participate only under the supervision of a parent/guardian
• By using the platform, you confirm you meet these requirements

• Registration via phone/email is mandatory
• You are responsible for: account security and accuracy of information
• ACTIV may suspend accounts for false or misleading data

• All bookings must be made through the platform
• Payments are processed via third-party gateways
• A booking is confirmed only after successful payment

This includes but is not limited to:

• No-show
• Late arrival
• Change of plans

Users agree to:

• Follow all venue rules and safety guidelines
• Arrive on time
• Behave respectfully toward staff and other participants
• Use facilities responsibly

Venue partners agree to:

• Provide accurate listings and pricing
• Honor all confirmed bookings
• Maintain safety and operational standards
• Ensure staff professionalism and service quality
• Complete mandatory KYC verification

• Venue partners set their own prices
• ACTIV charges a commission between 10%–15%
• Commission structure may be updated with notice

Payouts are initiated:

• After activity completion or no-show
• After a 24-hour buffer period
• Payments are made after deduction of ACTIV commission

• If a user does not show up → booking is considered completed
• If a partner fails to provide service: ACTIV may take corrective actions (including suspension)
• Refund decisions (if any in the future) are at ACTIV's sole discretion

The following are strictly prohibited:

• Fraudulent activity
• Misuse of the platform or data
• Harassment or abusive behavior
• Circumventing the platform for direct transactions

• Users and partners must not misuse data obtained via ACTIV
• Unauthorized use of personal or business data is prohibited

By booking or participating in any activity, you acknowledge:

• Sports and wellness activities involve inherent risks
• Risks include injury, illness, disability, or death
• Participation is voluntary and at your own risk

To the maximum extent permitted by law, ACTIV shall not be liable for:

• Injuries or accidents
• Death or physical harm
• Service quality issues
• Venue conditions or equipment failure
• Any indirect, incidental, or consequential damages

All services are provided by independent venue partners. ACTIV:

• Does not guarantee safety or quality
• Does not supervise or control venues
• Is not responsible for partner actions or omissions

You agree to indemnify and hold harmless ACTIV, its founders, employees, and affiliates from claims, legal disputes, and damages arising from:

• Your use of the platform
• Participation in activities
• Violation of these Terms

ACTIV reserves the right to suspend or terminate accounts for:

• Fraud or abuse
• Policy violations
• Harmful behavior

All platform content, branding, and technology are owned by ACTIV and may not be copied or reused without permission.

ACTIV may update these Terms at any time. Continued use of the platform implies acceptance of the updated Terms.

• These Terms are governed by the laws of India
• Any disputes shall be resolved through arbitration in Chennai, Tamil Nadu
